What course topics were of most interest to you? Why?

Discrimination in Employment was the most informative subject for me. I understand that discrimination does happen, but the extent of it was not so clear. Discrimination is so prominent today in the work environment and a lot of employees are victim of this behavior and don’t know the rights they have. My research on religious discrimination was extremely compelling. I have never experience discrimination, but the thought of someone being mistreated due to their beliefs was very disturbing and unethical. So I appreciate the laws that have been set in place to protect individuals that fall under these conditions.

What information from the course will you use as a professional?

Ethics and the law would be a concept that I would apply to my organization. Understanding what is legal and what is ethical as expanded since this course. My ethical perspective is that dealing with such subject I learned that it basically deals with a human understanding on what is right or wrong. The legal perspective deals with the law that has been set by the government so people will do what is right. I would treat my employee with the upmost respect and dignity but the regulations of my business will be governed by the laws.

What areas of employment law do you find most challenging?

The think the Affordable Care Act is the most challenging due to the fact of abiding by the regulations employer have to go by to be in a legal standing. It requires the employers to provide minimum essential health coverage for employees or face a penalty. The cover maintained should be to a standard level according to the business that allows for access to medical care by the employees without large overhead payments. The act also demands that employers provide inform their workers on the Marketplace coverage including how to get help regarding the Marketplace coverage. The penalty for not providing insurance cover will be a $2,000 bill for every employee that does not have a cover. Any failure to cover 60% or create an affordable cover will be penalized a $3,000 bill for any employee that will be forced to pay credit. (Roberson, 2017)

What issues or concerns related to compliance did you identify with your current or past organization?

The company I worked for in the past doesn’t offer benefits to their employee’s because they are hired as part-time with variable hours. This makes it hard on the employee because most of them are working forty hours a week, but can’t get health insurance through the company that currently has over a hundred employees.

What solutions would you suggest after going through this course?

In a situation that I stated above I would recommend the Affordable Care Act through the Marketplace for the employers that can’t get insurance through their employers. I would also recommended as far as discrimination in the workplace that managers get their employee the right training class on how to deal with discrimination and the regulation requirements.

Given the changing nature of the work environment, where do you see the need for the biggest legislative change in employment law in the near future?

The Fair Labor Standard Act would be the biggest change people are just not able to survive with the minimum wage of today.” The Act requires employers of covered employees who are not otherwise exempt to pay these employees a minimum wage of not less than $7.25 per hour. Youths under 20 years of age may be paid a minimum wage of not less than $4.25 per hour during the first 90 consecutive calendar days of employment with an employer. Employers may not displace any employee to hire someone at the youth minimum wage.
